Adjudication of Stamp Duty: Meaning, Fees, and Procedure

Stamp duty is a crucial part of document execution and registration. However, there are situations where the exact stamp duty payable on a document is unclear or disputed. In such cases, the law provides a formal mechanism known as adjudication of stamp duty.

What Can Be Done If the Required Stamp Duty Is Not Clear?

If there is confusion or uncertainty regarding the stamp duty payable on a particular document, an application can be made to the Collector of Stamps for adjudication.

The applicant must submit:

  • An application for adjudication, and

  • The document on which stamp duty is required to be assessed

The Collector of Stamps examines the document and determines the correct stamp duty payable.

What Is the Fee for Adjudication of Stamp Duty?

The fee for adjudication of stamp duty is ₹100 per document.

What Is the Procedure Followed in Adjudication of Stamp Duty?

After submission of the application, document, and supporting papers, the following steps are taken:

1. Decision by the Collector of Stamps

  • The Collector of Stamps passes a reasoned and self-explanatory order on the adjudicated document

  • This decision is generally issued within 45 days from the date of submission

2. Adjudication of Unsigned or Recently Signed Documents

  • If an unsigned document, or

  • A document signed within one month from the date of execution

is submitted for adjudication, and the applicant is willing to pay the assessed stamp duty:

👉 On payment of the assessed stamp duty, the Collector certifies the document as “duly stamped.”

3. Adjudication of Documents Submitted After One Month

  • If the document is submitted for adjudication after one month from the date of signing, and

  • The applicant agrees to pay the assessed stamp duty along with applicable penalty (if any):

👉 On payment of stamp duty and penalty, the Collector certifies the document as duly stamped.

Adjudication helps:

  • Ensure documents are legally compliant before registration

  • Prevent rejection of documents by the Sub-Registrar

  • Provide certainty regarding stamp duty liability
